How Can We Stop Judicial Activism Or Judges From Legislating From The Bench Like Those In The Iowa Ruling Did?

You have asked a very relevant question. We have gotten to the point where judicial activism has become a significant problem. The judicial system, as you mention, is only supposed to be tasked with maintaining the laws that our elected legislators enact with the approval of the executive branch. Whether you support (or not) the Iowa judicial activism, all of us should be concerned with this trend. These types of decisions should be made with our elected officials and NOT the judicial system.
The MORAL majority cannot be silent.
Californification is a cesspool of deviancy and even they were able to vote down gay marriage! KUDOS to them.

You mean like that wrong wing judges on the United States Supreme Court who used white out to remove ‘A well regulated Militia, being necessary to the security of a free State’ from the USA Constitution.
Stop electing the republicans that nominate these judges that think they legislators that can rewrite the constitution.

I’ll tell you what… I’m from California and for the second time we the people in this outrageous state voted in FAVOR of traditional marriage… after the first time, activist judges (can’t get more lib than our judges) overturned the will of the people and so we rose up and got that “evil” Prop 8 on the ballot. We spoke for the second time and it was again contested in court. This time it looks like the judges are respecting our will…
You the ordinary people are going to have to do like we did. Get enough signatures to get a Prop on the ballot to Amend your state constitution (hate to do it,but desperate times call for desperate messures)…
Rise up and hold your judges accountable. Marriage is NOT a Constitutional matter, therefore by voting on it, for or against gay marriage, the judges are basically breaking the law by overriding your will…

LOL! Yeah…and they said the Constitution of Iowa calls for equal protection under the law. That’s not rewriting…that’s interpreting the Constitution accurately. Here’s an actual quote from Judge Mark S. Cady”
“We have a constitutional duty to ensure equal protection of the law.”
Exactly WHAT part of that don’t you understand? How in the world is that rewriting the law? Honestly..how? Please tell me as I don’t think you have any idea. Here’s another quote from Judge Cady:
“We are firmly convinced the exclusion of gay and lesbian people from the institution of marriage does not substantially further any important governmental objective”
Aren’t you from the party of less government? Why in the world would the government have any objective to keep gays from getting married? What interest does the government have in this at all?
I suppose you would be for amending the state constitution and putting discrimination into the constitution? THAT my friend would be rewriting the law.
edit: Come on Mike…I’m still waiting…how does ensuring equal protection under the Constitution rewrite law? I have a feeling I’ll be waiting for a long time.
We have to drag the constitution back into the center of our politics. And maybe educate a bunch of folks to what it is and what it says so there can be a higher degree of intelligent debate. Or is that now and oxymoron?
The judges in the Iowa Supreme Court were mainly Republicans. They were just following the constitution not to discriminate.
Those judges only upheld the decisions of a lower court, which interpreted the law as being unconstitutional on a state level. The citizens will need to amend the constitution.

You can’t stop Judges from performing their duties without changing the Constitution.
